Faggione Re-appointed Chairman of Rules Committee
January 10, 2020 - Goshen, NY - Orange County Legislative Chairman Steve Brescia has named Legislator Thomas Faggione as Chairman of the Rules, Enactments, and Intergovernmental Relations Committee for 2020. This marks the third consecutive year Faggione has been named Chairman.
Faggione (R,C,I), represents the City of Port Jervis, Town of Deerpark and Town of Mount Hope. He is in his second term. Faggione also holds a seat on the Personnel and Compensation Committee, and the Public Safety Committee.
“My duty in government is to make sure we enact laws that defend freedom, and protect citizens. So much of that can be understood via the Constitution. I’m never at a meeting without my pocket Constitution.” said Faggione.
The Rules, Enactments, and Intergovernmental Relations Committee includes legislators Michael Amo , Katie Bonelli, Barry Cheney, Kevin Hines, James Kulisek, Michael Paduch, and John Vero.
The functions of the Statutory Committee on Rules, Enactments and Intergovernmental Relations shall, but not by way of limitation, include the following:
a) To recommend to the Legislature, upon request of the Legislature, the Chairman of the Legislature or on its own initiative, rules, regulations and procedures for conduct by the Legislature of its business and offer the same to the Legislature for its action thereon.
b) To review the Legislature's Legislative Manual annually with amendments incorporated therein and recommend its adoption by the Legislature.
c) To render opinions or advise on any matters included in the Legislative Manual, upon request by the Chairman of the Legislature or any Legislator.
d) To recommend to the Legislature and its committees the form, content and frequency of all formal reports prepared for the Legislature· by any officer, department head, agency head, County employee or for work performed for or by the County through service contracts or agreements.
e) To review and advise upon the legality, relevance or appropriateness of issues before the Legislature upon the request of the Chairman of the Legislature or any Legislator or the County Executive or County Attorney.
f) To receive, assess and advise the Legislature upon any proposed service contracts for work for or by the County with other units of local government, contractors, or service organizations, except all contracts, agreements or mandates between the County and any units of the Federal or State Government, where matching funds or reimbursement are involved, must first be analyzed by and reviewed with the recommendation of the County Executive and the relevant officer, commissioner or department head.
g) To receive from other jurisdictions within the County their originated ordinances, local laws, enactments or other legislation requiring action by the County Legislature, and recommend to the Legislature its action thereon.
h) To review any proceedings or negotiations concerning joint undertakings with other counties or regional governmental associations, upon request of the Chairman of the Legislature and within the guidelines established by the Legislature.
i) To receive, assess and advise the County Attorney and the Legislature on any suits or threatened suits by or against the County as well as any litigation of County interest or involvement except condemnation proceedings concerning rights of way and non-payment of taxes.
j) To hear complaints and grievances outside the operations of an individual County government unit or department from any aggrieved person or institution except grievances where grievance procedures are otherwise established.
k) To review and recommend to the Legislature, facts, opinions and recommendations on proposed legislation on matters of interest to the County and County government for introduction to or pending before the State and Federal Legislatures.
l) To review activities and performance for compliance with legislative intent of the Department of Law, County Clerk, Department of Planning, Board of Elections, Jury Board, Planning Board, representation of the indigent pursuant to Article 18-b of the N.Y.S. County Law, the Legal Aid Society and all other departments, agencies, boards, commissions, etc. of County government not specifically assigned to a particular Statutory Committee.
m) To promulgate and recommend a Code of Ethics for County Legislators, officers, employees and all persons having or conducting affairs with the County government to the Legislature which shall be adopted by the Legislature, except that recommendations as to content shall not be binding upon the Legislature.
